1. Agreement
These Terms of Use are an agreement between you and Ada Tech Solutions Inc. (“AdaTech”, “we”, “us”) for KithPlan. By downloading, purchasing, or using KithPlan, you agree to these terms and Apple’s Standard EULA. If they conflict, mandatory law and the Apple terms that govern the App Store transaction control.
If you are not old enough to enter this agreement where you live, a parent or guardian must review and accept it for you.
2. The service
KithPlan helps people plan group events, coordinate schedules, shopping and costs, share event information through iCloud, and review practical outdoor readiness. Features may depend on compatible Apple devices, an Apple Account, iCloud, network access, permissions, region, and third-party availability.
3. Free use and Organizer Plus
- Invited guests can join and participate without a KithPlan subscription.
- The free organizer plan supports up to two active hosted events.
- Organizer Plus adds unlimited active hosted events, reusable event copies, advanced planning tools, and ongoing organizer features.
- Apple Health access is optional, read-only, and is not a paid capability.
Organizer Plus is offered as an auto-renewable monthly or annual subscription. Payment is charged to your Apple Account when you confirm. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel it in your Apple Account subscription settings. Apple handles billing, taxes charged at checkout, Family Sharing availability, cancellations, and refund requests under Apple’s rules.
4. Your content and collaboration
You retain ownership of content you create. You give AdaTech and Apple the limited rights needed to process, store, display, and transmit it to provide KithPlan and the iCloud shares you request. You are responsible for having a lawful basis to add guest names, emails, photos, expense details, and other information, and for sharing only with intended participants.
Hosts control their iCloud event records and shares. People with edit access may change or delete shared information. Keep an export when independent records matter, and do not use shared event fields for confidential medical, financial-account, identity-document, or password information.
5. Safety, Health, and weather
KithPlan is a planning aid. It is not an emergency service, medical device, medical advice, professional guide, rescue system, weather authority, navigation system, or guarantee of safety.
Outdoor activities involve changing conditions and inherent risks, including injury, illness, exposure, equipment failure, route hazards, and delayed assistance. Weather, alerts, maps, health summaries, readiness findings, and checklists can be incomplete, delayed, inaccurate, or unsuitable for your circumstances. Verify authoritative forecasts and alerts, follow local rules, use appropriate equipment and training, communicate limits, and seek qualified medical or outdoor advice when needed. Contact local emergency services in an emergency.
6. Acceptable use
You must not use KithPlan to:
- break the law, infringe rights, harass people, or distribute harmful or deceptive content;
- collect or disclose personal information without appropriate permission;
- interfere with KithPlan, Apple services, security controls, or other users;
- misrepresent KithPlan output as professional medical, rescue, legal, financial, or safety advice; or
- reverse engineer or commercially exploit KithPlan except where the law expressly permits it.
7. Changes and availability
We may improve, add, remove, suspend, or discontinue features. We do not promise uninterrupted or error-free operation. Where a paid feature materially changes, we will provide any notice or remedy required by law or Apple’s rules.
8. Warranties and liability
To the maximum extent permitted by law, KithPlan is provided “as is” and “as available” without warranties beyond those that cannot legally be excluded. AdaTech is not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, missed events, personal decisions, or reliance on safety, weather, map, health, or third-party information.
Nothing in these terms limits liability or consumer rights that cannot legally be limited. Apple is not responsible for KithPlan support beyond its obligations under the Standard EULA and App Store terms.
9. Termination
You may stop using KithPlan at any time and cancel subscriptions through Apple. We may restrict use for a serious or repeated breach, security threat, or legal requirement. Provisions that by nature should survive termination—including ownership, safety responsibilities, disclaimers, and liability limits—continue.
10. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without excluding mandatory consumer protections or dispute rights that apply where you live.
11. Contact and changes
